Monette Technology Group Website & Hosting Terms
Effective date: October 24, 2026
Scope
These Website and Hosting Service Terms (“Service Terms”), available at monette.tech/terms, cover website builds, hosting subscriptions, and content changes provided by Monette Technology Group LLC (“MTG”). They apply when a client signs or submits an order form, affirmatively accepts these Service Terms during signup, or enters into an MSA that incorporates these Service Terms. MTG’s records of executed agreements, electronic acceptances, update notices, and the revision history of these Service Terms may be used to establish the version applicable to a client and the effective date of that version.
If you have a signed Master Services Agreement with MTG, documents control in this order if they conflict: (1) a signed SOW or order form, but only to the extent it expressly identifies the provision it overrides; (2) the MSA; and (3) these Service Terms. If you do not have an MSA, these Service Terms and your SOW or order form are the agreement between you and MTG.
Website builds
- Deposit. The deposit listed on the Price Sheet, SOW, or order form starts the build and applies toward the final price. Deposits are non-refundable once MTG begins planning, scheduling resources, provisioning, purchasing, configuration, development, or other performance for your project, except to the extent required by applicable law.
- Scope. The base build is the hosted site with email and phone links. Contact forms and other features are add-ons, priced in your quote or SOW.
Client website data. If MTG processes personal data submitted through a client website, including contact-form submissions, MTG processes that information on the client’s behalf to provide the applicable services. The client remains responsible for its privacy notices, collection practices, instructions to MTG, and other obligations applicable to the client’s use of that data. MTG may use subprocessors reasonably necessary to provide the services, subject to the MSA where applicable and applicable law.
Revisions. Each build includes two revision rounds unless the applicable SOW or order form states otherwise. Round 1 may be provided verbally, including during a review call, and MTG will confirm the requested changes in writing. Round 2 must be submitted in writing as exact “remove” and “replace with” wording for each change. Additional revision rounds are billed at MTG’s then-current hourly rates. If you have an MSA with MTG, Section 3 of the MSA controls in the event of a conflict.
- Your content. You're responsible for the accuracy of the text, photos, and info you provide, including typos. We'll flag errors we notice as a courtesy. Delays from repeated errors or missing content are billed at our hourly rate.
- Approval. You review the site on a preview link before launch. Launch happens after your approval and payment of the remaining balance.
Subscription plans
All plans include hosting, SSL, and DNS management. Hosting may use third-party cloud infrastructure selected by MTG. MTG does not own or control that underlying infrastructure and does not guarantee availability beyond a service level expressly stated in an applicable SOW or order form.
| Plan | Content changes | Contact form (email + SMS) | Business email | Hourly discount |
|---|---|---|---|---|
| Hosting | None | Add-on | Add-on | None |
| Hosting + Quarterly | 1 per calendar quarter | Add-on | Add-on | None |
| Premium | 1 per month | Included | 1 mailbox + 1 shared mailbox included | Yes |
Unused content changes don't roll over. Additional mailboxes are available on any plan, and each one adds 1 shared mailbox at no extra charge. Plan prices are on the Price Sheet.
Content changes
One content change = up to 5 edits, submitted together on our change-request form. For each edit, paste the current text and the new text.
Content changes cover:
- Menu items and prices
- Phone, email, and address
- About and description text
- Adding or removing a team member
- Swapping a photo you provide
Content changes don't cover new pages, layout or design changes, new features, or anything that changes how the site works. Those are quoted separately.
Business hours have their own editor and don't count toward your 5 edits.
Add-ons and additional work
Third-party providers. MTG may use third-party providers for cloud and website hosting, business email and file storage, scheduling, analytics, contact-form and email delivery, payment processing, electronic signatures, customer relationship management, telecommunications, software licensing, password management and security, APIs, plugins, and AI-enabled tools. These third-party services are governed by their providers’ applicable terms, policies, service levels, and availability. MTG may replace or change providers when reasonably necessary to provide or support the services. Microsoft and other third-party products, subscriptions, or licenses provided or administered by MTG remain subject to the applicable provider terms and conditions. You are responsible for accepting and complying with those terms where required. MTG may provision, administer, support, or bill for those products but does not grant rights beyond those provided by the applicable provider.
Add-ons, such as contact forms and additional mailboxes, are billed at the prices on the Price Sheet. Hourly work is billed in three tiers:
- Tier 1: support, and content work beyond your plan
- Tier 2: front-end web, network, and systems administration
- Tier 3: back-end, SSO, MFA, and advanced email support
Premium subscribers get the hourly discount shown on the Price Sheet. Any project expected to take more than 10 hours is quoted in an SOW before work starts.
Every SOW may include planning and project management time, about 10% of the estimated hours, minimum 1 hour. For projects expected to run 40 hours or more, we start with a paid discovery session (typically 2–4 hours). Its cost is credited toward the project if you sign the SOW within 30 days.
Billing and cancellation
- Payment. Invoices are due within 15 days after the invoice date. Subscriptions are billed monthly in advance. Amounts not paid when due accrue a late fee of 1.5% per month, calculated as simple interest, or the maximum lawful rate if lower. Client must notify MTG in writing of any good-faith invoice dispute within 10 days after the invoice date, identifying the disputed amount and basis for the dispute. Amounts not timely disputed are deemed accepted, and Client must timely pay all undisputed portions. After written notice, MTG may suspend work or services, in whole or in part, on an account more than 15 days past due and may suspend a hosted website on an account more than 60 days past due. MTG is not liable for delay, loss, or interruption resulting from a suspension permitted under these Service Terms.
- Term. Plans are month-to-month. Discounted 12-month or longer agreements are available.
- Cancellation. Cancel anytime with 30 days' notice. No refunds for partial months.
- Downgrades. If you leave Premium within 12 months of starting it, the one-time contact form add-on fee on the Price Sheet applies.
- Moving your site. When your account is current, MTG will provide its then-standard export of your website files and reasonable cooperation to initiate transfer of a client-owned domain. Any additional transition, migration, configuration, data extraction, conversion, consulting, registrar, registry, or other third-party fees are your responsibility and are billed at MTG’s then-current rates where applicable. MTG may require advance payment before performing transition or migration work. Domain transfers remain subject to registrar and registry requirements. MTG will not sell, redirect, cancel, or intentionally allow expiration of a client-owned domain solely as collection leverage.
- Prices. Current prices are on the MTG Price Sheet. We may change prices with 30 days' written notice, and changes take effect at your first billing cycle after the notice period. Prices are locked for the length of any extended-term agreement, except pass-through fees, which can rise only by the amount the original vendor raises them.
Your responsibilities
- Provide content you own or have permission to use. You're responsible for claims arising from content you supply.
- Keep your contact info current so we can reach you about your site.
- Don't use your site for anything illegal, deceptive, or harmful, including malware, spam, or infringing material. We may take a site offline that breaks this rule and will tell you why.
- Keep your own login details secure if we give you access to any system. You remain responsible for your users, credentials, devices, content, data, configurations, accounts, and systems except to the extent an applicable SOW or order form expressly assigns a specific responsibility to MTG.
Ownership and credit
- Your content stays yours.
Your finished site belongs to you once it is paid in full, excluding MTG Materials and Third-Party Components. MTG keeps all rights to its pre-existing and reusable code, templates, frameworks, tools, methods, know-how, and generalized, non-client-specific improvements (“MTG Materials”). MTG Materials do not include client confidential information or a deliverable identified in an SOW as created exclusively for you. Once paid in full, you receive a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, maintain, and permit your service providers to use MTG Materials solely as incorporated in the finished site. The license may be transferred only with the applicable deliverable or your business. It does not extend to MTG’s hosted platforms, portals, or other subscription services except while the applicable subscription remains active.
Domains registered or managed by MTG may be held in MTG’s registrar account for administrative convenience. You remain the beneficial owner of a domain purchased for you, and MTG acts as its administrative and technical manager. You are responsible for registration and renewal fees, except as included in your plan, and for keeping ownership and contact information current. You may instead register and control your own domain and remain responsible for its fees, configuration, access, and security.
Credit. Each site may carry a small “Powered by Monette Technology Group” credit link in the footer, and MTG may display the site in its portfolio without disclosing your confidential information or implying your endorsement. MTG will remove either at no charge upon your written request.
Other terms
- Availability. We use reliable hosting and work to keep your site up, but we don't guarantee uninterrupted service. Premium plans can add regional redundancy in the regions you choose, where available. Scheduled maintenance, emergency maintenance, third-party outages, internet failures, attacks, and events outside MTG’s reasonable control do not constitute a breach of an uptime obligation unless an applicable SOW or order form expressly provides otherwise. Unless expressly stated in an SOW or order form, MTG does not provide managed cybersecurity, continuous monitoring, incident response, penetration testing, compliance certification, backup or disaster recovery, or other managed security services.
- Warranty. For 30 days after launch, MTG will correct at no charge a defect in MTG’s work that causes the site not to operate materially as described in the applicable SOW or order form. You must report the defect in writing during that period. This warranty does not cover client or third-party changes, client content, third-party services or updates, or use outside the agreed scope.
- Liability and disclaimer. To the fullest extent permitted by law, MTG’s aggregate liability arising from these Service Terms is limited to the fees you paid or payable under the affected order during the 3 months before the event giving rise to the claim. MTG is not liable for lost profits, lost revenue, loss of goodwill, lost or corrupted data, business interruption, or indirect, incidental, special, exemplary, punitive, or consequential damages. Except for the limited warranty above, services and deliverables are provided “as is,” and MTG disclaims implied warranties, including merchantability and fitness for a particular purpose. These limits do not apply to your payment obligations or liability that cannot lawfully be limited, including fraud or willful misconduct.
- Governing law; general terms. Minnesota law governs, and disputes will be heard in the state or federal courts serving Dakota County, Minnesota. Notices may be sent by email to the address associated with your account. Electronic acceptance and signatures are valid. These Service Terms, together with the applicable SOW or order form and any MSA, are the entire agreement on their subject. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. Neither party may assign the agreement without consent, except to a successor in a merger, sale, or transfer of substantially all related assets.
Changes. MTG may update these Service Terms prospectively by giving at least 30 days’ written notice by email. An update takes effect on the first renewal or billing cycle after the notice period. An update will not retroactively affect completed work or an existing claim, override a signed MSA, SOW, or order form, or change pricing fixed for an extended term except for permitted pass-through fees. Continued use of the services after the effective date constitutes acceptance of the updated Service Terms. MTG’s records of executed agreements, electronic acceptances, update notices, and the revision history of these Service Terms may be used to establish the version applicable to a client and its effective date.
